Summary

Federal Law provides for a quality assurance privilege in nursing homes. The scope of this privilege is interpreted differently across the country. In litigation, nursing home Defendants often attempt to assert this privilege over a large number of documents to prevent their disclosure during discovery. The way the privilege is construed will dictate whether or not a large number of documents are discoverable - including nurse consultant mock surveys, incident reports, tracking and trending documents and many others. This privilege is almost always an issue in any case involving nursing home abuse and neglect. There is a line of cases and arguments that are relevant to litigating this issue that any attorney handling these cases needs to know.
